Several projects tied to Southern Pines’ 2040 Comprehensive Plan have been placed on hold after changes in state law limited the town’s zoning authority.
Senate Bill 382 Impacts Local Zoning Authority
Under Senate Bill 382, local governments are now prohibited from initiating “down-zoning” — reducing development density or permitted property uses — without the consent of affected property owners. The law also prevents the creation of new nonconformities within zoning districts.
During a recent meeting, the Town of Southern Pines Council denied a proposal to implement character district design standards for downtown and West Southern Pines. These districts were identified in the town’s 2040 Comprehensive Plan as areas deserving unique design protections.
Tree Protection and Landscaping Changes Partially Approved
The council partially approved a package of landscaping code updates, including a recommended plant species list. However, broader tree protection measures were shelved due to potential conflicts with the new state law.
Town planning staff say they are exploring alternative approaches to preserve Southern Pines’ tree canopy and historic character while remaining compliant with state regulations. Another bill, Senate Bill 587, is currently under consideration in the North Carolina House and could potentially restore local authority.
The developments highlight ongoing tension between statewide legislation and local planning priorities in Moore County and across the Sandhills region.
