New Medicaid Eligibility Limits Take Effect in North Carolina

New federal eligibility rules taking effect October 1 may end full Medicaid coverage for thousands of North Carolinians with certain noncitizen immigration statuses.

People affected by the change may lose coverage for routine doctor visits, prescriptions, dental services and mental-health treatment. Emergency Medicaid may remain available for qualifying medical emergencies, but it does not replace comprehensive coverage.

Who may remain eligible

NC Medicaid says lawful permanent residents may remain eligible, although most green-card holders must complete a five-year waiting period. Lawfully residing children younger than 19 and lawfully residing people who are pregnant or gave birth within the previous 12 months may also qualify.

Cuban and Haitian entrants and citizens of Micronesia, the Marshall Islands or Palau living in the United States are among the additional groups that may remain eligible. Applicants must still meet applicable income and other program requirements.

What recipients should do

Anyone whose coverage is ending should receive an official letter explaining the decision and appeal process. Recipients generally have 60 days from the date of the notice to appeal.

NC Medicaid advises recipients to make sure their local Department of Social Services has their current address and telephone number. Families should also respond promptly to requests for information and carefully review every deadline in their notices.

A parent’s immigration status does not prevent an otherwise eligible child from receiving Medicaid. Free help with notices and appeals is available through the NC Medicaid Ombudsman at 1-877-201-3750.
